Fault in a used car: making a complaint
A used car can turn out to be faulty soon after the purchase. When you buy from a car dealer as a consumer, you have strong protection; in a private sale the protection is narrower. This guide explains how to establish the fault, complain correctly and where you can take the dispute.
You will need
- The deed of sale and any inspection report
- The sales advert or a screenshot of it
- A garage's estimate or fault diagnosis
- Photos and notes on how the fault appeared
Steps
Find out the type of sale
If you bought from a car dealer, the Consumer Protection Act applies. In a sale between private individuals, the Sale of Goods Act applies, and an "as is" clause limits liability but does not release the seller from responsibility for a concealed defect.
Document the fault
Compare against the information and the car's age
Complain promptly and in writing
Make a clear claim
Give the seller a chance
